JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,307 and 504/34 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that the informant being S.I. of Police, received information with regard to the cross firing in village Harpur between two groups. The informant rushed to the place of occurrence when Dafadar Janardan Singh and Choukidar Rabindra Sawan informed that some hot exchange took place between Guru Yadav, Suraj yadav and three unknown for consuming liquor and for the same on 29.11.2015 at 9 P.M. both groups assembled and resorted to firing on each other.

No.15862 of 2016 (3) dt.26-04-2016 2/2 It is submitted by the learned counsel for the petitioners that admittedly no injury was caused to any one nor any cartridge was found at the place of occurrence. Statement to that effect has been made in paragraph 11 of the petition. Statement has also been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Munger in connection with Mufassil P.S. Case No.246 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
