JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 406, 379, 467, 468 of the Indian Penal Code and u/s 138 of the N.I. Act. As per the prosecution case, cheques issued by coaccused, Nitin Kumar and Bablu Kumar Yadav were dishonoured on account of insufficiency of fund. So far this petitioner is concerned, he is Moharir in Registry office and he on the request of informant has made a Chalan of Rs. 1,13,000/- for registration of the sale deed.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The cheques in question were issued by co-accused, Nitin

No.16395 of 2022(2) dt.27-09-2022 2/2 Kumar and Bablu Kumar Yadav and petitioner has not taken any farthing and on the request of informant he prepared Chalan of Rs. 1,13,000/-. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Madhepura in connection with Madhepura PS case No. 693/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
