The petitioners apprehend their arrest in Belaganj P.S. Case No. 54 of 2016 registered for the offences punishable under Sections 406, 420, 468, 504, 120(B) and 34 of the Indian Penal Code.

The informant filed the complaint case on the basis of which the present FIR is registered. The informant alleged that a cooperative society was formed with 20 members including the petitioners. All the members contributed and set up a fund to help the members of the society. The informant alleged that the petitioners have taken loan of Rs. 3,39,120/- but did not return the money.

Patna High Court Cr.Misc. No.16044 of 2016 (5) dt.27-07-2016 2/2 Learned counsel for the petitioners submits that no chit or paper is filed to show that the petitioners ever received any loan from the society rather contribution money of the petitioners is lying with the society and the informant is trying to misappropriate the entire amount.

Considering the facts aforesaid and the fact that no chit or paper is filed to show that the petitioners ever received any loan from the society, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Gaya in Belaganj P.S. Case No. 54 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
