The petitioner seeks bail in Ram Nagar P.S. Case No. 27 of 2022, registered for the offence punishable under Sections 376, 511, 506 of the Indian Penal Code.

As per the FIR, petitioner was arrested while attempting to commit rape with the informant on the point of knife.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. In fact, there was love affair between the petitioner and the informant but father of informant did not like the petitioner. Informant herself called the petitioner when her husband was not present at home where petitioner was caught. The informant is major. Petitioner claims clean antecedent and he is in custody since 19.01.2022.

Patna High Court CR. MISC. No.15505 of 2022(2) dt.16-05-2022 2/2 Investigation is complete.

However, counsel for informant vehemently opposed the prayer for bail and submitted that petitioner was apprehended on the spot.

Considering the facts and circumstances of the case and period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 27 of 2022.
