JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Bettiah Mufassil P.S. Case No. 103 of 2018, disclosing offences under Sections 324, 307, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per F.I.R. is that while the brother of informant was going by motorcycle, there was indiscriminate firing by unknown miscreants and the informant suspected the hands of the petitioners and other accused persons as they were threatening his brother.

Submission of learned counsel for the petitioners is that they have no criminal antecedents and except suspicion there is absolutely nothing against them and one of the accused

Patna High Court CR. MISC. No.18504 of 2019(3) dt.06-05-2019 2/2 person has been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 12.04.2019 passed in Cr. Misc. No. 23796 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, in connection with Bettiah Mufassil P.S. Case No. 103 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
