JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Trial No. 2253 of 2018, arising out of Complaint Case No. C2361 of 2017, in which cognizance has been taken under Sections 420 IPC and under Section 4 of D.P. Act. Allegation against the petitioner is that son of the petitioner was engaged with the daughter of the complainant and Rs.4.5 lakh was taken by the petitioner and thereafter petitioner started demanding Rs.3 lakh and due to that later on marriage of daughter of the complainant was broken and petitioner is not returning the money.
Submission of learned counsel for the petitioner is that petitioner has already returned Rs.4.5 lakh in presence of the witnesses, which will appear from Annexure-2 and Annexure-2
Patna High Court CR. MISC. No.18130 of 2019(2) dt.02-04-2019 2/2 further disclosed that nothing is due with the petitioner and daughter of the complainant has already married with another person. Heard learned APP and learned counsel for the complainant, who has opposed the prayer for anticipatory bail on the ground that Rs.3 lakh is due with the petitioner. Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sadar, Motihari, East Champaran, in connection with Trial No. 2253 of 2018, arising out of Complaint Case No.
C2361 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
