2. Petitioners apprehend their arrest in a case registered for the offence punishable under section 366 A of the Indian Penal Code .

3. As per the prosecution case, co-accused Vivek Kumar (son of both the petitioners) is alleged to have enticed the daughter of the informant with the intention to solemnize marriage with her.

4. It is submitted on behalf of the petitioners that petitioner No. 1 is mother and petitioner No. 2 is father of coaccused Vivek Kumar. Specific accusation of kidnapping the

Patna High Court CR. MISC. No.17915 of 2024(4) dt.19-06-2024 2/2 victim is against co-accused Vivek Kumar. The victim in her statement recorded under Section 164 Cr. P.C has denied the prosecution case and has categorically stated that she on her own sweet will solemnized marriage with co-accused Vivek Kumar.

5. Learned counsel for the State oppose the bail petition.

6 Considering the statement of the victim recorded under Section 164 Cr. P. C. and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Munger in connection with Laraiyatand P.S. Case No. 09 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
