The petitioners have prayed for regular bail in a case instituted for the offence under Sections 304B, 201, 341, 323, 504, 506, 120B and 34 of the Indian Penal Code. The allegation against the petitioners along with others is of killing the daughter of the informant due to nonfulfillment of dowry demand of Rs. 2 lacs and one Bullet motorcycle.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They have committed no offence. Petitioners are brother-in-law of the

He submitted that the petitioners have no concern with mess and business of the deceased as well as her husband and also both the petitioners are living separately from them. Husband is already in custodySimilarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 11.5.2023 passed in Cr. Misc. No. 16676 of 2023. Petitioners have got no criminal antecedent and both are languishing in judicial custody since 16.12.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Vaishali at Hajipur in connection with Kartaha P.S. Case No. 92 of 2022.
