JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2017 The petitioner seeks regular bail in connection with Rajapakar P.S. Case No. 36 of 2017, registered for offences punishable under Section 393 of Indian Penal Code. Allegation against the petitioner is of trying to snatch the motorcycle of the informant and on hulla villagers assembled and caught the petitioner on spot.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and no occurrence as alleged has taken place in fact that dispute took place with regard to petty occurrence of accident in motorcycle of petitioner and informant. Further petitioner has been in judicial custody for last seven months and though he is accused in two other cases but he is on bail in those cases.
Patna High Court Cr.Misc. No.46869 of 2017 (2) dt.11-10-2017 Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and as petitioner is accused in two more cases, I am not inclined to release the petitioner on bail, at this stage, rather this application is disposed of with direction to the court below to release the petitioner on bail to his satisfaction, once charge is framed in this case with the condition that he will cooperate in the Trial and shall appear on each and every date, failing, which his bail bond shall be cancelled.
