JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2020 Learned counsel of the petitioner submits that he shall remove the defects when the Court starts normal functioning. Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 29.9.2018 in connection with Majhagarh P.S. Case No. 299/2018 registered for the offences punishable under Sections 414 of the Indian Penal Code Section 25(1-B)a, 26 and 35 of the Arms Act. Learned counsel appearing for petitioner submits that due to typing error at paragraph 3 in place of Uchkagaon P.S. Case No. 255 of 2018, it has, inadvertently, been typed as Uchkagaon P.S. Case No. 255 of 2019. He, further, submits that petitioner is said to be caught with stolen Scorpio vehicle and one countrymade katta is said to have been recovered from his

He also submits that so far Uchkagaon P.S. Case No. 255 of 2018 is concerned, the same was registered against the petitioner and others almost for similar offence.

Learned Additional Public Prosecutor opposed the prayer.

Considering the aforesaid facts and circumstances as well as period of detention of petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/concerned court in connection with Majhagarh P.S. Case No. 299/2018.

It is made clear that if the petitioner shall not remove the defects, as pointed out by the office, within four weeks from the date when Court starts normal function, then the office shall list this case under appropriate heading before the appropriate Bench for passing necessary order.
