Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons took the key from the socket of the vehicle of the informant on the point of gun and threw him out and eloped from there in the said vehicle towards Gopalganj. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.18540 of 2020(5) dt.21-10-2021 2/2 case. He submits that for the same offence the petitioner was made accused in one another case being Majhagarh P.S. Case No. 299 of 2018 under Sections 414 of the Indian Penal Code and Sections 25-A, 26 and 35 of the Arms Act in which he has been granted bail. He further submits that petitioner is languishing in judicial custody since 28.11.2018. Considering the facts and circumstances of the case and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned court below/successor court where the case is pending in connection with Uchkagaon P.S. Case No. 255 of 2018.
