The petitioner apprehends his arrest in connection with Kasma P.S.Case No.17of 2015 registered under Section 47(A) of the Excise Act.

As per FIR, on secret informant and raid, 100 liters of Mahua wine was recovered from the joint house of the petitioner. It has been submitted on behalf of the petitioner that from the joint house of the petitioner, 100 liters of Mahua wine is said to have been recovered. It is further submitted that noting has been recovered from the exclusive possession of the petitioner and that the petitioner has got no concern with the alleged recovery of Mahua wine.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts that the recovery has been made from the joint house of the petitioner, the petitioner, named above, in the event of his arrest/surrender in the court below

Patna High Court Cr.Misc. No.21546 of 2015 (2) dt.09-07-2015 2/2 within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Kasma P.S.Case No.17 of 2015, subject to condition as laid down under section 438(2) of the Cr.P.C.
