The petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 179/2020 registered for the offences punishable under Section 302 of the Indian Penal Code.

Pursuant to the order dated 27.04.2022, show cause has been filed on behalf of the Superintendent of Police, Sitamarhi by Mr. Jharkhandi Upadhyay, learned Additional Public Prosecutor for the State.

Perused the show cause dated 09.05.2022 filed on

Patna High Court CR. MISC. No.25229 of 2021(13) dt.16-05-2022 2/2 behalf of the Superintendent of Police, Sitamarhi. It appears from the perusal of the aforementioned show cause that the last order dated 27.04.2022 has been complied and a departmental proceeding has been initiated against Saket Bihari, Sub-Inspector of Police, Bathnaha Police Station, Sitamarhi (now under Suspension).

Considering the fact that no material has come during investigation to connect the petitioner with the crime and there is no chance that the petitioner will abscond, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case No. 179/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Saif/- U T
