JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under Sections 406, 420, 465, 467, 468 and 471 of the Indian Penal Code and Section 138 of the N.I. Act.
As per the F.I.R. the petitioner took Rs. 8,01,000/-
Patna High Court CR. MISC. No.15777 of 2022(3) dt.18-07-2022 2/3 through different cheques from the complainant for selling land. Thereafter, accused petitioner refused to register the said land and cheque of Rs. 5 lacs was given to the complainant by the petitioner, but the said cheque got bounced due to insufficient fund.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is involved in seven criminal cases as stated at para 3 of the bail petition. The petitioner is in custody since 29.09.2020.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna-cum-N.I.Act, Patna, in connection with Complaint Case No. 3250 ( C ) of 2018, with a condition :-
1. If the petitioner is found involved in similar nature of offence in future his bail bond will liable to be cancelled by
Patna High Court CR. MISC. No.15777 of 2022(3) dt.18-07-2022 3/3 the court concerned.
The Trial Court is directed to conclude the trial within four months.
The application stands allowed.
