JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsels for the petitioner, complainant and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Complaint Case No. C.A. Case No. 1002/2013 for the offences instituted under Sections 323, 498(A) and 379/34 of the IPC.341, 504, 506 and 498(A)/34 of the IPC., but the cognizance was taken only under Section 498(A) of the IPC. The prosecution story, in brief, is that the marriage of the complainant was performed with accused Gautam Chouhan on 15.11.2008 and she went to her Sasural. After some days, her husband and other accused put pressure on the complainant to
Patna High Court Cr.Misc. No.21762 of 2015 (3) dt.04-09-2015 2/2 bring Rs. 25,000/- and a cow from her father. When the demand of the accused could not be fulfilled, they subjected the complainant to torture and cruelty. They stopped her food. Panchayati was also convened, the accused kept her well for some days thereafter again tortured her and lastly ousted from the house after snatching her belongings.
It has been submitted by learned counsels for the petitioner and the opposite party no. 2 that they are agree to reside together.
Considering the said fact, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Complaint Case No. C.A. Case No. 1002/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Purnea, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
