The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. The prosecution case is that the son of the informant Sonu Kumar was assaulted by the First Information Report named accused persons on 29.08.2015. When Sonu raised Alarm, Tuntun Chaudhary came to rescue, then he was also assaulted by the accused persons. It is further alleged that the petitioner went to the house of the informant and assaulted the daughter-in-law of the informant. They also misbehaved with her and snatched her ear ring and gold chain.

Patna High Court Cr.Misc. No.16580 of 2016 (2) dt.18-04-2016 It is submitted by the learned counsel for the petitioners that for a petty dispute accusation has been levelled. The occurrence took place in the house of the informant hence, it can not be treated to be a place of public view. For the occurrence of 29.08.2015 the First Information Report was registered on 12.09.2015. The accusation is omnibus and general.

Considering the delayed lodging of the case and coupled with the statement made in para-3 of the petition that petitioners have no criminal antecedent, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghatti in connection with Barachati P.S. Case No. 390 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
