The petitioner apprehends his arrest in Ekchari P.S. Case No.02 of 2019 registered under Sections 420, 409 and 34 of the Indian Penal Code.

The gist of the allegation is that the petitioner being a Panchayat Secretary did not hand over the folder and register of teachers' appointment.

Learned counsel for the petitioner submits that the petitioner was posted as Panchayat Secretary before appointment of teachers and no document was with the petitioner. The petitioner has already informed this fact to the superior officers but even then the case has been lodged. One more case was lodged with similar allegation against the petitioner and the petitioner has already been enlarged on bail

Patna High Court CR. MISC. No.15379 of 2020(2) dt.11-09-2020 2/2 vide order passed in Cr.Misc.No.57127 of 2018. Having considered the facts and the nature of allegations made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Ekchari P.S. Case No.02 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U T
