The petitioner is in custody in connection with Sahebganj P.S. Case No. 8 of 2017 on his remand since 14.06.2017 for the offence registered under Sections 392 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that he was taken into custody in connection with another case on 13.01.2017 and in the said case, the petitioner's confessional statement was recorded, in which, he has implicated himself in connection with the present case. So far as other case is concerned, the petitioner has already been granted bail. Considering the aforesaid facts and circumstances of the present case and the petitioner is not named in the first information report and that the confessional statement made before the police, has no evidentiary value, let the petitioner,

Patna High Court Cr.Misc. No.40785 of 2017 (2) dt.19-09-2017 2/2 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., West Muzuffarpur in connection with Sahebganj P.S. Case No. 08 of 2017.
