The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant who was married to the younger brother of this petitioner was done to death by the accused persons including the petitioner herein for non-fulfillment of demand of dowry to the tune of Rs.2 lacs and a motorcycle.

It is submitted by learned counsel for the petitioner that the petitioner happens to be the elder brother of the husband of the deceased. He has no concern with the day to day affairs of the deceased and her husband. The husband of the deceased is in custody. As per instructions received, the father-in-law and

Patna High Court CR. MISC. No.26217 of 2021(3) dt.20-12-2021 2/2 mother-in-law of the deceased have been enlarged on anticipatory bail vide order dated 17.12.2021 passed in Cr. Misc. no.43834 of 2021. The petitioner is in custody since 16.8.2020.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the husband of the deceased being in custody and the petitioner having remained in custody for over 1 year 4 months, the Court directs the petitioner to be enlarged on bail in connection with Hasanganj P.S. Case no.36 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
