JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.10.2017 seeks bail in Koilwar PS Case No. 256 of 2017 registered under Section 302 of the IPC.
The allegation in brief is that the informant's sister came to his house, his father left the house along with the informant and others remained in the house, next morning information was given by the petitioner regarding his wife condition suffering from some illness and when the informant reached found that the petitioner was trying to take away the dead body in a vehicle. Learned Counsel for the petitioner submits that the petitioner is own sister of the informant, the allegation against the petitioner is of entering into conspiracy to get the informant's wife killed but the petitioner is not involved in the said offence, there was no such motive for committing the said crime, the petitioner informed her brother early in the morning and the informant has also seen five-six persons coming out of the house and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the
Patna High Court Cr.Misc. No.29957 of 2018 (4) dt.18-07-2018 petitioner, namely, Pooja Devi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur, Ara in connection with Koilwar PS Case No. 256 of 2017. (Arun Kumar, J) Snkumar/- U T
