JUSTICE SHIVAJI PANDEY ORAL ORDER 04-11-2020 Heard learned counsel for the petitioner and learned APP for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with Sessions Trial No. 326 of 2019, arising out of Jadia P.S. Case No. 51 of 2014, registered for the offence under Section 395 of the Indian Penal Code.

Allegation has been made that the accused persons including this petitioner have intercepted the informant and on the point of revolver looted an amount of Rs.5.6 lacs from him. Learned counsel for the petitioner submits that the name of the petitioner has come during investigation on the confessional statement of co-accused Bambam Yadav and on the basis of the aforesaid confessional statement, three more

Patna High Court CR. MISC. No.14011 of 2020(4) dt.04-11-2020 2/2 criminal cases have been lodged against the petitioner. He further submits that nothing has been recovered from the possession of the petitioner and no T.I. Parade has been conducted, inasmuch as, the petitioner is in jail since 01.07.2019. He next submits that co-accused Bambam Yadav has been granted bail by this Court in Criminal Miscellaneous No.16173 of 2020.

Considering the period of custody as well as the fact that co-accused Bambam Yadav has been granted bail by this Court, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - IV, Supaul / In-charge Successor Court, in connection with Sessions Trial No. 326 of 2019, arising out of Jadia P.S. Case No. 51 of 2014, subject to the condition that the petitioner shall mark his presence before the nearest Police Station by 7th of every month for six months. (Shivaji Pandey, J) pawan/- U T
