The petitioner being the then Panchayat Secretary of Gram Panchayat Raj Dhama is facing accusations punishable under Sections 409, 420, 120B of the Indian Penal Code vide Raniganj, P.S. Case No. 290 of 2015, registered on the complaint lodged by the B.D.O, Raniganj. The report of the Senior Deputy Collector contained in letter no. 78 dated. 11.06.2014 is the basis of FIR.
The counsel for the petitioner draws attention of the Court to the said report from which it appears that in the purchased of furniture and other accessory for the Panchayat Bhawan, some illegalities were found. Some of the purchased
Patna High Court Cr.Misc. No.17050 of 2016 (2) dt.27-04-2016 2/2 articles were not found placed in the Panchayat Bhawan. The Panchayat Secretary of Gram Panchayat Raj Dhama was interrogated and he disclosed that some articles are kept in the house of Mukhiya. In the background of the matter, it has been submitted that the allegation made in the FIR pertains to the Mukhiya of the Gram Panchayat.
Considering the facts and circumstances of the case, I am persuaded to extend the privilege of anticipatory bail, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Araria in Raniganj P.S. Case No. 290 of 2015 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
