This application is filed for grant of regular bail in connection with Baligaon P.S. Case No. 80 of 2022, registered under section 414 of the Indian Penal Code and sections 30(a), 36 and 41(1) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that there is recovery of 2288.52 litres of liquor from three vehicles. The petitioner is in custody since 04.02.2023 and he has clean antecedent.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.16265 of 2023(2) dt.22-05-2023 2/2 bail.

Considering the period of custody and the nature of allegations levelled against the petitioner as well as the fact that he has clean antecedent, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1 -cum- Additional District and Sessions Judge, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 80 of 2022.
