1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Gurua P.S. Case no. 388 of 2025 registered under sections 96, 137(2) and 3(5) of the Bhartiya Nyay Sanhita, 2023.
3. As per the prosecution case, the informant states that his 16 year old daughter was taken away by the petitioner for the purpose of marriage.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No occurrence in the manner as alleged in the FIR has taken place. The petitioner is in custody 13.11.2025 and charge sheet has been submitted in the case. He has no criminal antecedent.

Patna High Court CR. MISC. No.16292 of 2026(3) dt.06-05-2026 2/2 A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, the contents of the statement of the daughter of the informant recorded under section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023 wherein she does not support the prosecution case together with the petitioner having remained in custody for over 5 months since 13.11.2025, charge sheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Gurua P.S. Case no. 388 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
