The petitioner has preferred this application for grant of regular bail in a case registered under sections 364A of the Indian Penal Code.

As per the prosecution case, the husband of the informant asked the informant to arrange for Rs. 30 lacs or else his life would be in danger. The informant states that it appeared that her husband has been kidnapped.

It is submitted by learned counsel for the petitioner that the petitioner who is a lady has been falsely implicated in the case. Even as per the statement under section 164 Cr.P.C. the allegation against the petitioner is that she called husband of the informant to her place where he was confined by the accused

Patna High Court CR. MISC. No.26222 of 2021(3) dt.21-12-2021 2/2 persons. It is submitted that the accused Sushil Kumar and Sonu Kumar have been enlarged on bail vide order dated 7.10.2021 passed in Cr. Misc. No. 19982 of 2021. The petitioner is in custody since 1.11.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to the above named co-accused and the petitioner having remained in custody for 1 year, the petitioner is directed to be enlarged on bail in connection with Mahesi P.S. Case no. 335 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, East Champaran at Motihari.
