2. Heard the parties.

3. The present writ petition has been preferred for the following relief(s):

"for issuance of a direction to the respondent no. 4 to proceed with the Rent Fixation Appeal no. 203 of 2012-13 as per Remand order passed by Additional Collector, Vaishali at Hajipur in Rent Fixation Appeal Case No. 1015 of 2018-19 as contained in Annexure-P/2"

Learned counsel for the petitioner submits that a decision was taken and vide memo no. 29 dated 15.03.2021 the Additional Collector, Vaishali at Hajipur had given a positive direction to the Deputy Collector Land Reforms, Hajipur to dispose of the Rent Fixation Case No. 203 of 2012-13 afresh as the earlier order dated 16.05.2016 was set aside (Annexure-P/2 to the petition). Instead, the respondent no. 4, the Deputy Collector Land Reforms, Hajipur is lingering the matter.

5. Learned State counsel submits that if the same has not been disposed of, the concerned respondent will be disposing it of in next three months.

6. It is unfortunate that the respondent no. 4 is defying the order of the Additional District, Collector, Vaishali forcing the petitioner to file the writ petition, if the contention of the petitioner is correct.

7. In that background, the writ petition stands disposed of with a direction to the respondent no. 4, the Deputy Collector, Land Reforms, Hajipur to take up the matter and dispose it of if still not disposed of within a period of three months from the date, the order is provided to the Office after hearing all the necessary parties.

8. Failure to do so, the petitioner shall be free to take up the matter by filing a proper contempt petition. (Rajiv Roy, J) Adnan/- U
