The petitioner seeks bail in Singheshwar P. S. Case No. 103 of 2015 registered under Section 392 of the Indian Penal Code.
Three unknown motorcycle borne criminals are said to have snatched the motorcycle, mobile and documents of the informant.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. His name has surfaced in the case on the basis of his confessional statement given before the police which
Patna High Court Cr.Misc. No.46164 of 2017 (2) dt.21-09-2017 2/2 has no evidentiary value in the eye of law. The petitioner was not put on T.I.P. Similarly situated co-accused Sonu Yadav has been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 21755 of 2017 vide order dated 11.05.2017. The petitioner has been languishing in custody since 05.07.2015. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P. S. Case No. 103 of 2015.
