JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 339, 379 and 307/34 of the Indian Penal Code.
The accusation against the petitioner is of causing injury with lathi on the head of the informant whereas other accused persons also assaulted the informant.
It is submitted by learned counsel for the petitioner that for petty dispute, the accusation has been levelled and the injury of the informant has been found to be simple.
It is submitted by learned counsel for the State that the injury has been found on the right parietal of the informant, though, the same has been found to be simple in nature. A statement has been made in para 3 of the petition that the
Patna High Court Cr.Misc. No.21804 of 2015 (2) dt.21-05-2015 2/2 petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Rani Talab P.S. Case No. 23 of 2015 pending in the court of learned ACJM, Danapur. Accordingly, the application is disposed of.
