JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. It would appear from submissions of the parties that charge against the petitioner has already been framed and matter is pending for recording the evidence of prosecution witnesses. There is specific allegation against this petitioner that he gave several dagger blows causing death of the deceased and, therefore, taking note of the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and, again, his prayer for bail in connection with Session trial no. 148/2016 arising out of Awatarnager P.S. Case no. 97/2015 pending in the court of Addl. Sessions Judge X, Saran at Chapra stands rejected.
Patna High Court Cr.Misc. No.41913 of 2017 (2) dt.30-08-2017 However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible preferably, within six months from the date of receipt/production of a copy of this order, failing which petitioner may renew his payer for bail before the trial court itself.
