JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-05-2018 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Itarhi P.S. Case No. 240 of 2017 for the offences punishable under Sections 302/34 of Indian Penal Code.

Allegation in brief is that when the deceased was going on motorcycle, he was intercepted by the accused persons and on exhortation of the petitioner and one Ritesh Singh, Jitendra Singh shot at Vinod Singh and thereafter Rajendra Singh again shot at the deceased. The occurrence is said to have been committed due to land dispute.

Learned senior counsel for the petitioner submits that due to land dispute the petitioner has falsely been implicated, he is

No.30415 of 2018 (2) dt.22-05-2018 2/2 above 60 years of age, the petitioner is said to be the order giver but there is no allegation against him of shooting at the deceased. It is further submitted that similarly situated co-accused persons have already been granted bail by order dated 22.02.2018 passed in Crl. Misc. No. 10544 of 2018 and order dated 19.04.2018 passed in Crl. Misc. No. 21951 of 2018. The petitioner is languishing in custody since 12.03.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. at Buxar in connection with Itarhi P.S. Case No. 240 of 2017.
