JUSTICE ARUN KUMAR ORAL ORDER 15-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.11.2017, seeks bail in Chutiya PS Case No. 59 of 2017 registered under Sections 364A and 34 of the IPC.

Learned Counsel for the petitioner submits that the FIR is against unknown, there is no material against the petitioner except disclosure of his name in the confessional statement of co-accused, similarly situated another co-accused Sugreev Kharwar was admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 17465 of 2018. It is further submitted that the boy has returned very next day but has not named the petitioner nor identified him as no TIP was held and charge-sheet has been submitted in this case. Having considered the said facts and circumstances, the petitioner, namely, Premchand Chaudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Aditi Gupta, Judicial Magistrate, lst Class, Dehri-on-Sone, Rohtas in connection with Chutiya PS Case No. 59 of 2017. Snkumar/- (Arun Kumar, J) U T
