Petitioners, already in custody, seek bail in connection with Marhowrah PS Case No.84 of 2017, registered under Sections 147, 148, 149, 452, 380, 323, 324, 307, 504, 506 and 527 of the Indian Penal Code.

Allegation in brief is that all 13 accused persons variously armed assaulted the informant causing injury on his head, when others came to his rescue, they were also assaulted. It is contended that both sides are neighbours and there is case and counter case, both sides suffered injury, however there is no specific overt act alleged against the petitioner rather allegation is general and omnibus and petitioner

Patna High Court Cr.Misc. No.30517 of 2018(2) dt.16-05-2018 2/2 no.2 has not criminal antecedent; whereas only one antecedent is against petitioner no.1.

Having considered the aforesaid facts and circumstances, petitioners, namely, Dhirendra Singh @ Dhiri Singh @ Dhiri @ Dhirendra Kumar Singh and Amit Singh are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Marhowrah PS Case No.84 of 2017.
