A supplementary affidavit has been filed on behalf of the petitioners as directed by the earlier order dated 21.05.2015 with regard to the minority of petitioner No.2 as has been claimed in the main anticipatory bail application.
In the said supplementary affidavit, it has been clearly stated that due to inadvertence, the petitioner No.2 was shown to be a minor aged about 10 years whereas he is, in fact, aged about 26 years.
The petitioners have renewed their prayer for anticipatory bail after the prayer has been rejected earlier by order dated 23.12.2013 passed in Cr. Misc. No.33599 of 2013. The matter involves death of a young woman, for which a case under Section 304B/34 of the Indian Penal Code has been
Patna High Court Cr.Misc. No.22864 of 2015 (3) dt.22-07-2015 instituted. It has also come during the course of investigation that the death has been caused on account of strangulation and not by poisoning as has been alleged by the petitioners and other coaccused. No fresh material has been pointed out by learned counsel for the petitioners so as to become entitled to the grant of anticipatory bail.
In the aforesaid circumstances, the prayer for anticipatory bail of the petitioners is rejected.
