This is an application for bail in connection with Mahila P.S.Case No. 32 of 2016 registered for the offences punishable under Sections 498A, 494, 323, 307, 379, 504, 506 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. Allegation against the petitioner is of demanding dowry and subjecting the informant to cruelty. Further allegation is that he has tried to set her on fire but she anyhow escaped. It has been submitted on behalf of the petitioner that the informant is in habit of filing such type of cases and earlier in the year 2012 she has lodged a case of similar type against the petitioner and in that case he has been granted provisional anticipatory bail and thereafter the present case has been filed
Patna High Court Cr.Misc. No.39063 of 2017 (2) dt.19-08-2017 2/2 against the petitioner with similar allegation and he is in custody for more than one month. It has further been submitted that the matter has been settled between the parties vide Annexure-3. Heard learned APP also.
Having heard both sides and considering the aforesaid facts and circumstances, this application is disposed of with a direction to the court below to verify the authenticity of Annexure3 and if it is so, the court below will release the petitioner on bail to its satisfaction.
