The petitioner is apprehending his arrest in a case instituted under Sections 498A and 379/34 of the Indian Penal Code and 3 / 4 of the Dowry Prohibition Act.
Allegation against the petitioner is to have tortured the informant on account of non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that both the parties have settled the issue outside the court and they are ready to lead their conjugal life together.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of
Patna High Court Cr.Misc. No.23253 of 2015 (3) dt.21-09-2015 2 / 2 the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Mahila P.S. Case no. 10 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, if the petitioner fails to give the informant with all respect and dignity, the informant will be at liberty to file petition for cancellation of bail of the petitioner.
