The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 323, 341, 324, 448, 307, 379, 504 and 506 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that while the informant along with family members were at the darwaja, the accused persons variously armed assaulted them due to which they sustained injury.

It has been submitted on behalf of the petitioner that the petitioners are in custody since 9.1.2019 and have got no

Patna High Court CR. MISC. No.16545 of 2019(2) dt.11-04-2019 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against the petitioners nor any injury has been attributed against the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S.
