JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-03-2019 The petitioners seek bail in anticipation of their arrest in connection with Nabinagar P.S. Case No. 18 of 2019 dated 14.01.2019 instituted for the offences under Sections 341, 323, 427, 379, 384, 504, 506, 34 of the Indian Penal Code and Section 37(b) and 37(c) of the Bihar Prohibition & Excise Act, 2016.
The allegation against the petitioners is of having picked up a fight with the waiter of a hotel after having consumed food. Since one of the associates of the petitioners was found drunk, the offence under the
Patna High Court CR. MISC. No.16503 of 2019(2) dt.15-03-2019 2/3 Excise Act has also been added.
The learned counsel for the petitioners has submitted that because of the poor quality of food having been served to the petitioners, they protested and the waiter, instead of apologizing for bad quality of food, picked up fight with the petitioners. Only because one of the associates of the petitioners, unfortunately, was drunk, the case was lodged by the owner of the hotel, implicating the petitioners.
Regard being had to the background facts of this case and taking into account the clean antecedents of the petitioners, they, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Nabinagar P.S. Case No. 18 of 2019,
