In this case, the petitioner is seeking anticipatory bail in connection with Excise Case No.96 of 2020, registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The police has recovered 500 literes of country made liquor from the Auto Rickshaw and the petitioner is owner of the vehicle, however, counsel for the petitioner submits that his vehicle was stolen for which he has filed a complaint before the Sub-Divisional Magistrate, Dehri, Rohtas, but for theft of vehicle, normal person can lodge an FIR before the police station and not the SDM. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within six weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order preferably on the same day without being influenced by the order of this Court.
