JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Nawada P.S. Case No. 546 of 2016 registered for the offence punishable under sections 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been implicated in this case due to political rivalry. There is no allegation that petitioner without procuring paddy made payment to the farmers. Not a single farmer has come forward to complain anything against this petitioner. On inquiry (Annexure-3), the RTGS of the concerned beneficiaries was cancelled, and as such, there is no question of withdrawing huge money. Petitioner has no criminal antecedent.

No.45134 of 2017(2) dt.19-09-2017 2/2 Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada P.S. Case No. 546 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
