JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2018 Heard learned counsel for the petitioner and learned APP for the State as well as learned counsel representing the informant.

The petitioner is seeking regular bail in connection with Valmikinagar P.S. Case No.36 of 2018 for the offence punishable under Section 306 of the Indian Penal Code. Learned counsel for the petitioner submits that the wife of the informant committed suicide on 31.03.2018, however, on the next day the F.I.R was lodged stating that the petitioner was abusing the wife of the informant and was making baseless allegations against her because of which his wife bolted her inside a room and after pouring kerosene oil she set herself on fire.

No.32359 of 2018 (2) dt.12-06-2018 2 /3 Learned counsel for the petitioner submits that the wife of the informant has committed suicide inside the house of the informant and for that it is the informant who has to explain the circumstances; so far as the present petitioner is concerned it is submitted that he is only one of the neighbours of the informant and had no concern with the family affairs of the informant, therefore, there was no reason as to why he will indulge in abusing or any other act of torture.

On the other hand learned APP for the State as well as learned counsel representing the informant opposed the prayer for bail and submits that it is because of the baseless allegations made by the petitioner against the wife of the informant that she committed suicide.

Considering the facts and circumstance of the case whereunder the petitioner is said to be a neighbour and the suicide has been admittedly committed inside the house of the informant, I am inclined to grant regular bail to the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Bagaha at West Champaran, in connection with Valmikinagar P.S. Case No.36 of 2018 subject to the conditions as laid down under
