The petitioner apprehends his arrest in connection with Sheikhpura P.S. Case no. 443 of 2017, registered under Sections 420 and 379/34 of the Indian Penal Code. The accusation is that on 30.11.2017 informant entered into the ATM of P.N.B. situated at Chandni Chowk for withdrawal of money. In the meantime, three persons entered in the ATM room and took his ATM of SBI and started to run away. On chase, Kanhaya Kumar was apprehended, who disclosed the name of petitioner as his associate. Learned counsel for the petitioner submits that it would appear from the F.I.R. itself that petitioner has not been apprehend from the spot rather his name surfaced on the

Patna High Court CR. MISC. No.16279 of 2019(3) dt.19-06-2019 2/2 confessional statement of Kanhaya Kumar. The petitioner has no criminal antecedent.
