JUSTICE PARTHA SARTHY ORAL ORDER 01-06-2020 Heard learned counsel for the petitioner and learned APP for the State, through video confrencing. The petitioner has filed the instant application for grant of regular bail in connection with Belchhi P.S. Case No. 67 of 2019 registered for the offence under sections 302, 307, 147, 148, 149, 341, 323, 325 and 504 of the Indian Penal Code. As per allegation in the FIR, it is stated by the informant that while he proceeded on his tractor towards his agricultural land, eighteen named accused persons including the petitioner herein came variously armed, started to abuse and asked the informant not to cultivate his land. On being asked not to abuse, the accused persons started to assault his father and on the informant's younger brother coming to his father's rescue, he was also beaten up badly. It is stated by learned counsel for the petitioner that the allegations as levelled against the petitioner are false and he has been implicated only for the purpose to extort money from him. No specific allegation has been levelled against the petitioner and he is stated to be a member of mob. The petitioner has no criminal antecedent and is in custody since 4.11.2019. The application for bail is opposed by learned APP for the State.

Having heard the learned counsel for the parties and taking into consideration the facts of the case and the petitioner being in custody since 4.11.2019, the court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Belchhi P.S. Case No. 67 of 2019 on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Barh, Patna.
