JUSTICE RAVI RANJAN ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 409, 420 and 120(B) of the Indian Penal Code and Section 7 of Essential Commodities Act.
As per the allegation, two trucks were intercepted at Bhagalpur Bausi Road near Baijanii Petrol Pump in which altogether 503 bags of wheat were found having mark of Food Corporation of India.
It is contended that the petitioner is Driver of one of the seized truck and he is having clean antecedent. The driver of the another seized truck as well as the owner of the truck have already been granted anticipatory bail by a coordinate Bench of
Patna High Court Cr.Misc. No.16904 of 2016 (3) dt.25-05-2016 2/2 this Court vide order dated 10.05.2016 passed in Cr. Misc. No.18037 of 2016 and vide order dated 27.04.2016 passed in Cr. Misc. No.17054 of 2016.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Mohan Chandra Sah be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Jagdishpur P.S. Case No.37/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur subject to the conditions as laid down under sub-section
