Mr.Prem Kumar Jha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 326 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

The informant alleges that on 24.05.2021 at about 9:30 pm, when he was distributing food at his cousin's wedding, co-accused Cheeku Singh came and took him outside the house where 5-6 miscreants were present from before and it is alleged that Cheeku fired at the informant causing injury on his neck, further Manish handed over his pistol to Keshav Kumar who made two consecutive firing causing injury on his right thumb

No.16629 of 2022(2) dt.22-09-2022 2/2 and thereafter informant somehow managed to hide himself by taking advantage of darkness Learned counsel for the petitioner submits that petitioner has antecedent of three cases and all these cases stems out of dispute in the family, it is next submitted that specific allegation of firing is against Cheeku Kumar and Keshav Kumar and no specific overt act has been alleged against this petitioner. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Nawkothi P.S. Case No. 71 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
