The petitioner apprehends his arrest in Chiraiya P.S. Case No. 313 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioner was plucking papaya. The wife of the informant forbade him, but the petitioner assaulted her with Pharsa on her head. When the informant came to save, the petitioner also assaulted him.

It is submitted that there is a counter version. The informant and his wife made allegation of witch craft and tried to force Babita Devi to take nightsoil. The injuries found on the person of the informant and his wife are simple in nature. From the side of the petitioner's also many persons were injured.

No.16850 of 2015 (2) dt.06-05-2015 2/2 Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sikrahana at Motihari in connection with Chiraiya P.S. Case No. 313 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
