The petitioner seeks bail in connection with Katihar Rail P. S. Case No. 62 of 2019 dated 01.08.2019 instituted for the offences under Sections 401, 414 and 34 of the Indian Penal Code and Sections 137 and 147 of the Railway Act, 1989.

The petitioner is stated to be in custody since

Patna High Court CR. MISC. No.16569 of 2020(2) dt.02-06-2020 2/3 02.08.2019.

The petitioner and another are stated to have been arrested by the police from near the railway bridge. From the possession of the petitioner, mobile phones and cash were recovered.

No explanation was given by the petitioner on being questioned as to the reason for his loitering on the platform of the railway station. The petitioner is said to have confessed that he has committed theft from the passengers.

It has been submitted on behalf of the petitioner that he has been arrested on mistaken identity and the recovery of mobile telephones has been thrust upon him.

It has been urged on behalf of the petitioner that he is in custody for approximately ten months. Regard being had to the aforesaid facts and the period of custody, the petitioner, above-named, is directed to be released on bail on his furnishing bail
