JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Parsa Bazar PS Case No. 15 of 2017 registered under Section 302/34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that three FIR named accused persons namely Vikash Kumar, Ravi Kumar and Shivlal Sao had taken son of the informant on motorcycle and after some time he heard sound of firing and found four persons escaping away. Learned Counsel for the petitioner submits that the petitioner is not named in the FIR and there is no material against the petitioner except disclosure of his name by one Rajesh Ram and Umesh Kumar that he was hired for killing the deceased. However, the petitioner has/had no enmity with the deceased, he has no criminal antecedent and is in custody since 30.4.2017.

Having considered the said facts and circumstances, the petitioner, namely, Raushan Kumar @ Chhotu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, IXth, Patna in connection with Parsa Bazar PS Case No. 15 of 2017, Sessions Trial No. 359 of 2017.
