The petitioner has preferred this application for grant of regular bail in a case registered under sections 8(C), 21(b), 25 and 29 of the NDPS Act, 1985.

Total 122 grams of heroine in three plastic packets have been recovered from the shop of Bata. The petitioner and the co-accused person are the owner of the said shop. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.16024 of 2022(2) dt.20-07-2022 2/2 case. Nothing has been recovered from the conscious possession of the petitioner. The recovered heroine is of less than commercial quantity. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 06.11.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge cum Special Judge, NDPS Act, Rohtas at Sasaram, in connection with NDPS Case No. (Special No.) 11 of 2021, NCB P.S. Case No. 26 of 2021. The application stands allowed.
