1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148 , 149, 341, 342, 323, 353, 307, 336, 337, 427, 186, 188, 283, 285, 332 and 504 of the Indian Penal Code.

3. The informant alleges that on account of an accident the auto driver, Niranjan died and the accused persons including the petitioner had blocked the road and were protesting with the dead body accordingly, the informant on information, he along with police force reached the place of occurrence and saw the accused persons damaging parked vehicle and even abused and

Patna High Court CR. MISC. No.23227 of 2023(2) dt.16-08-2023 2/3 pelted stones causing injury to police force and the Magistrate and also damaged their vehicles but fled on arrival of additional police.

4. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is also submitted that from perusal of the allegation as alleged in the FIR it would manifest that no specific allegation of committing any overt act is alleged against the petitioner rather the allegations are general and omnibus in nature.

5. Learned A.P.P. Mr. Rabindra Kumar for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in

Patna High Court CR. MISC. No.23227 of 2023(2) dt.16-08-2023 3/3 connection with Khajanchi Hat (Maranga) P.S. Case No. 641 of 2015 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

7. The learned counsel for the petitioner at this stage submits that the defect as pointed by the Office shall be removed by tomorrow.
