Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 9.2.2017 passed in Cr. Misc. No.2810 of 2017 with an observation that the petitioner may renew his prayer for bail once the informant is examined in this case.

Submission of the learned counsel for the petitioner is that the informant was examined and she has named this petitioner but no allegation of assault is attributed against him and he is in custody for two years.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, and the fact that petitioner is in

Patna High Court Cr.Misc. No.30461 of 2018 (2) dt.17-05-2018 2/2 custody, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge, Gopalganj in connection with Kuchaikote P.S.Case no.210 of 2016, G.R.No.3113 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
